KEEP BIG BEND WILD applauds the plaintiffs and lawyers who successfully won the preliminary injunction last Friday ceasing all groundbreaking activity and “staying” all of the waivers in the entire Big Bend Sector. The data KBBW obtained from the NPS about apprehensions in the national park was an important plaintiff exhibit, and the subject of the testimony KBBW Chair and former BBNP Superintendent Bob Krumenaker discussed as the first “fact witness” called in the hearing.  This data clearly show that the national park and the sector are not an “area of high illegal entry”, which is the legally-required predicate for DHS to issue the waivers.

It’s sweet that this order followed quickly upon CBP’s announcement that they were ending the “pause” and would make a decision soon on what they actually plan to do in the national park and beyond.  Incredible that they were bulldozing a national park and yet didn’t (and still don’t) have an actual plan.

Find the preliminary injunction and all of KBBW’s court documents at keepbigbendwild.org/court-action.

All parties await the Judge’s “memorandum opinion” that will follow, which will more fully explain her reasoning. We also await the government’s decision on whether to appeal.  That’s likely, and until that’s resolved, we can’t rest for more than a moment.  Even if not appealed, the injunction lasts only until the case is resolved in the district court.  And while the Judge indicated that the plaintiffs were likely to succeed on the merits on at least one of their claims in the suit, no border infrastructure lawsuit has ever defeated DHS.

Hence we continue to work on the legislative strategy, as discussed in previous installments – stopping or delaying the appropriations in the congressional lame duck session after the midterms and getting a bipartisan bill introduced early in the next Congress.  We’re working on drafting the text of that bill now and will share it for review and hopefully get letters of support from community members, businesses, and local government this fall or winter.

Keep Big Bend Wild’s goal is a “Protect Big Bend Forever” Act establishing permanent, binding protection for the undeveloped areas of the national park; a permanent rescission of the waiver authority DHS has to operate at will without accountability; cancellation of the contracts; and a requirement that any major border infrastructure construction in the future would have to be explicitly authorized with site-specific legislation by a future congress and subject to normal environmental and cultural review, with meaningful opportunities for public involvement.

With enough support, and enough voices, we can get this done. With enough voices, we can get it done for more than just the national park – hopefully for the entire area from Fort Quitman to Amistad.

Congressional staff suggested in our Hill discussions that the likelihood of success for a Big Bend bill will be greatest if these elements are bundled together.  Let’s work together for this common goal!

CAMERA LENS

Hello.  I am reaching out in hopes that you might be able to help me locate a camera lens I lost in the Terlingua area. On or around September 2, 2026, I lost a Nikon NIKKOR Z 85mm f/1.2 S lens near the Ghost Town ruins in Terlingua, Texas.

I have been searching online and contacting local businesses and used camera retailers, but so far I have not been able to locate it.

If someone found the lens or knows of anyone who may have picked it up, I would be extremely grateful for the information. I am offering a reward for its safe return.

Terlingua Music Bash - October 15 -18 2026! The excitement level out there for The Bash is super high this year, it's going to be a fabulous weekend of music and friendship. Cabin 10 Inc. 501(c)3 charitable organization makes the festival happen, it has deep roots in both The Hill Country and Terlingua and as you can see, it's about half "hometown" Chihuahuan Desert players and half "visiting" Hill Country players, many of these friendships go back decades. It's totally unique, memories made at The Bash are priceless. If this will be your first Bash welcome aboard - come start new friendships, make some great music and help fund a local scholarship for Ghostown in appreciation... it's THE thing to do every 3rd weekend of October!

31st ANNUAL KEN & JOEE BARNES MEMORIAL SCHOLARSHIP FUNDRAISER - Join us November 14th for our annual Cribbage & Horseshoe tournaments (sign up at 9), BBQ (noonish) and silent auction at the Terlingua Ghostown Horseshoe Pits.

31st Annual Fundraiser for Terlingua High School graduate scholarships. We lost Joee May Barnes at the age of 16 after a tragic accident. The community opened their hearts and rallied to raise funds for our family, but it wasn’t needed for its intended purpose. We decided to return the money thru a Scholarship and my father, Ken Barnes, kept the scholarship fund going by honoring Joee’s memory with a Memorial Fundraiser every year. My husband, Jared, and I have kept the tradition going after Ken’s passing and the fundraiser now honors both their memories.

TERLINGUA STAR PARK - STAR PARTIES ARE HERE! ₊˚⊹☆
Public star parties have officially begun at Terlingua Star Park! Enjoy the same kind of laser-guided star tour and hands-on telescope experience inspired by our friends at McDonald Observatory, but at a fraction of the cost and much closer to Terlingua.
We keep our groups small, with a 20-to-1 guest-to-telescope ratio, so you get more time at the eyepiece. We can’t compete with McDonald’s world-class equipment and facilities (yet!), but we’ve modeled our program after theirs and are bringing that experience to the Big Bend community.
Most Fridays & Saturdays, with additional dates throughout the season.
Tickets & schedule: astromucho.com

CASI HALLOWEEN FUN NIGHT

Good day to everyone.  I know this is a bit early but we wanted to make sure we get the word out. Every year we have enjoyed having the kids come out to the CASI ranch trick or or treating.

Because Halloween falls the weekend before chili cookoff week, the CASI cooks have organized a Halloween fun night.  We would love to see the ghosts and goblins at the Ranch again this year.  Thank you!

BREWSTER COUNTY COMMISSSIONERS

Brewster County Special Commissioners Court Meeting Agenda September 30, 2026

ALPINE HUMANE SOCIETY

Dia de los Quesos Fundraiser

Is a local 501(c)(3) non-profit organization that was founded in 1986 to help the City of Alpine's pets and shelter. AHS was instrumental in partnering with the city to construct the current animal shelter, the former pet crematorium, and the Kokernot Dog Park. We maintain a Pet Food Pantry for community pets in need, a helpline with expert advice and resources, funds for community veterinary care, regional pop-up clinics, and a Cattery that serves as an interactive showcase for homeless cats and kittens vetted before adoption. We also collaborate with other area rescues to help the community.  Our Thrift Store generates about a third of our operating expenses, helping us continue this necessary work.

This year, we have provided more Community Assistance than ever before. Our efforts are not limited to Alpine; they also reach the towns in our region.  As of July 31st, we have spent $26,600 on community vet bills, and about $10,000.00 on our Free Terlingua Pet Clinic in August, where 105 pets were spayed and neutered, and an additional 76 had vaccines and Wellness visits with a veterinarian. We need your help to keep this life-saving work going.

Our main fundraiser each year is Dia de los Quesos. This year we have a queso contest, live music by Rome Antenucci with Roasted Rat, and Grupo Alegre, a pop-up bar by Alcove Social, a taco bar, and a silent auction at the Alpine Civic Center on Saturday, October 24th, from 6 to 9 pm.

Please consider donating good-quality collectibles, art, jewelry, tools, musical instruments, gift certificates, and other items of value. We will also accept sponsorships of $100 or more and will acknowledge sponsors on social media and at the event. All donations are eligible for a tax-deductible donation receipt.

Please contact us for donation pickup:

at 432-837-2532, 432-837-3400 or maryann@alpinehumanesociety.org

If you prefer, you can drop off your silent auction donation at the Alpine Humane Society Thrift Store and Cattery at 706 N 5th St., Alpine, TX 79830. Open from 11 am to 5 pm Mon – Sat.

BIG BEND NATIONAL PARK, Tex.

In early October, Big Bend National Park and the Texas Parks and Wildlife Department will initiate targeted wildlife management actions to protect native desert bighorn sheep. The project aims to reduce the population of non-native Barbary sheep, or aoudad, within the park, continuing the annual collaboration between the park and TPWD.

BIG BEND ARTS COUNCIL (BBAC)

The next show is our members’ show with an entry deadline at the end of October.  Please keep in mind that the show schedule, at least the themes/titles may be a little changeable but that should be all set by the first week of November.

We had a discussion about the holiday show and decided to make it a miniature show or at least small works….no larger than 12” X 12”.  Also, I would like to see if we can have a portion of the show be about nichos.  These would be small 3D boxes with a central theme.  The nicho format can be loosely based upon whatever object or concept you would like.  I know that Twin Peaks usually has a supply of cigar boxes for very cheap which could be modified into a small nicho.

A prospectus for this show will be forthcoming but right now the members’ show is fast approaching!

VOLUNTEER DEPUTY VOTING REGISTRARS

On Thursday, October 1st, Volunteer Deputy Registrars with the Tri-County Voter Promoters will register voters from 10am to 1pm at the Terlingua Post Office. If you are not registered, please do so. The registration deadline for the November 3rd election is Monday, October 5th. This election will determine the next Texas Governor, the next US Senator from Texas, and other important statewide positions (for example, lieutenant governor and attorney general).

The Tri-County Voter Promoters can also help voters check their registration or update their registration if their address or name has changed.

TERLINGUA STAR PARK GRAND OPENING
Astro Mucho invites the community to celebrate the grand opening of the Terlingua Star Park on Wednesday, September 30th. This free community event will feature live music, telescope time and a star tour under the Big Bend night sky.
Gates open at 7:00 p.m., with live music beginning at 7:15 p.m. and the star tour at 8:00 p.m.
Bring a chair or sit on the steps, and feel free to bring your own refreshments. A red light is recommended.

KEEP BIG BEND WILD!

Our DC week was exhausting, exhilarating, and highly successful. We strategized with staff of Texas congressional members on the House Appropriations Committee over opportunities in the lame duck session after the midterms to interrupt, delay, or prevent the already-appropriated funding for border infrastructure. That’s a long shot but they agreed, worth pursuing.

The more promising discussions were about legislation in the next Congress we’re calling the Protect Big Bend Forever bill which would rescind the waiver of federal laws and cease all major border infrastructure planning and construction; and assure no new development ever happens other than trails in the still-undeveloped 80-90% of Big Bend National Park.

Whether the border provisions will apply beyond the national park boundaries to any or all of the rest of the Sector will depend on what the congressional sponsors think can pass both houses and be signed by the President.

We spoke with staff for Reps. Cuellar, Escobar, Veasey, Doggett, Menefee, Casar and Pfluger from Texas and they’re all going to help. Heinrich, Luján, Stansbury, Vasquez, and Leger-Fernandez of New Mexico will be on board, and if there isn’t a Texas senator to lead in that chamber, I expect a New Mexican would. Arizonans Grijalva, Kelly, and Gallego will be there. Randall from WA. Tonko from NY. And those are just the ones we had time to meet with; many of them will recruit others.  We will work with them to determine who’ll write the bill, who’ll be the lead sponsors in each House, etc. There’s a ton of work to do but this was a terrific start.

We had offers from House and Senate offices to work with Legislative Counsel to develop specific bill language after we send them a first draft, which we plan to do this week.

The other major thing for this week is that the federal court in El Paso has rescheduled the evidentiary hearing that was postponed due to “the pause.” We’ll be testifying about the park-specific data, as KBBW obtained that from the NPS via a Freedom of Information Act request. (https://keepbigbendwild.org/big-bend-border-statistics/)

And, of course, the pause could end as early as Thursday. Like you, we are on edge. But with the hearing Friday, and agency-provided data that clearly show that the Big Bend Sector, and especially the national park, are not an “area of high illegal entry”, we are cautiously optimistic this judge will either extend the pause or issue an injunction.

A big thank you to everyone, especially local businesses, that have added your names to the Keep Big Bend Wild supporter list at keepbigbendwild.org/become-a-supporter.  While donations are helpful and appreciated (we're financially sponsored by the El Paso Community Foundation, a 501c3), your names as supporters are even more valuable.  If you have signed up once, no need to do it again! Local business and organizational supporters are especially important, and appreciated.  Elected officials see the growing number of real people, real businesses, and real organizations from real places that want to see Texas’ Gift to the Nation protected from destruction.  Not just in the short run – but in perpetuity.

KBBW is a strategic partner in the No Big Bend Wall Coalition.  Please follow us on our Facebook page.   #keepbigbendwild
